The O-1 visa allows for U.S.-based companies and agents to hire foreigners of extraordinary ability in the sciences, arts, education, business, or athletics to work in the U.S.
Who Qualifies?
Foreigners who have demonstrated “extraordinary ability” in the sciences, arts, education, business, or athletics through sustained national or international acclaim and are able to show achievements recognized in the field through extensive documentation.
Permanent resident status—popularly known as the “green card”—gives foreigners unlimited access to U.S. territory (i.e., to live and work in the United States indefinitely).
Who Qualifies?
Foreigners who have demonstrated “extraordinary ability” in the sciences, arts, education, business, or athletics through sustained national or international acclaim and are able to show achievements recognized in the field through extensive documentation.
A specific job offer is not required for an individual in this group, if the immigrant is entering the United States to continue work in the field in which he or she has extraordinary ability.
Therefore, the immigrant may file his or her own petition with USCIS for classification in this preference, rather than having the petition filed by an employer.
