EMPLOYMENT VISA
Arious visa categories are available for u.s. based companies to bring foreign workers of all levels including, unskilled, skilled, professional, and advanced professional to work in the u.s.
In addition to the e-2 and eb-5 investment visa and the o-1 and eb-1 extraordinary ability visa, there are various other visa categories for foreign workers including eb-2 for advanced professionals, eb-3 for unskilled, skilled, and professional workers, eb-1c and l-1 for multinational transfers, h-1b for professional workers, and h-2b for seasonal laborers.
Two visa categories allow for U.S.-based companies to transfer foreign employees with specialized or managerial knowledge from their parent company, subsidiary or affiliate established abroad. The L-1 nonimmigrant visa and the Eb-1c green card.
- The U.S.-based employer company must have a qualified corporate relationship with a foreign-based company.
- The prospective L-1 employee/transferee must have worked in a managerial capacity for at least one continuous year for the foreign-based company during the 3 years preceding the filing of the L-1 petition with USCIS.
- The prospective L-1 employee must come to the United States to fill a management or specialized knowledge position.
- The prospective L-1 employee must have the education and experience necessary to fill the position offered.
- The employer must offer the beneficiary a managerial or executive job in the U.S.
- The employer conducts business in two or more countries, one of which is the U.S.
- The employer has been doing business for at least one year
- The employer employed the beneficiary overseas for at least one continuous year within the three years immediately preceding the submission of the I-140 in a managerial or executive capacity
- The employer can pay the salary offered to the beneficiary
- The prospective employee must have the education and experience necessary to fill the position offered.
